TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the Scout Moto website and services. By joining the waitlist or using Scout products, you agree to these Terms.
1. Acceptance of Terms
By accessing our website or joining the Scout waitlist, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.
2. Waitlist Terms
2.1 No Payment Required
Joining the Scout waitlist is free and requires no payment or credit card information. You are not obligated to purchase when the product becomes available.
2.2 No Guarantee of Availability
Waitlist membership does not guarantee product availability, pricing, or delivery timeline. We will make reasonable efforts to fulfill waitlist orders but cannot guarantee supply.
2.3 Cancellation
You may remove yourself from the waitlist at any time by clicking "unsubscribe" in any email or by contacting jayden260100@gmail.com.
2.4 Product Specifications
Product features, specifications, pricing, and delivery dates are estimates and subject to change before shipping. We will notify waitlist members of significant changes.
3. Product Purchase Terms (When Available)
3.1 Payment
Payment will be collected at the time of order fulfillment, not when joining the waitlist. Accepted payment methods will be specified during checkout.
3.2 Pricing
- All prices are in New Zealand Dollars (NZD) unless otherwise stated
- Prices include GST for New Zealand orders
- Shipping costs will be calculated at checkout
- Prices are subject to change before order fulfillment
3.3 Delivery
- Estimated delivery: Q3–Q4 2026
- Delivery dates are estimates, not guarantees
- Initial shipping: New Zealand and Australia
- International shipping expansion timing will be announced
3.4 Returns & Refunds
Detailed return and refund policies will be provided at the time of purchase. Generally:
- 30-day return window for unused devices in original packaging
- Defective products covered by warranty (details to be specified)
- Subscription fees: pro-rated refunds for cancelled accounts
These return terms are in addition to, and do not limit, your statutory rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these Terms is intended to exclude or limit any rights you have under New Zealand law that cannot be excluded or limited by contract.
4. Subscription Terms (When Product Ships)
4.1 Subscription Plans
- Scout: $5 NZD/month after first 2 months included free
- Scout Pro: $8 NZD/month after first 2 months included free
- Pricing subject to change with 30 days' notice. Changes will be communicated via email to active subscribers before taking effect. You may cancel your subscription at any time before the new pricing applies at no charge
4.2 Billing
- Recurring monthly billing after free trial ends
- Payment automatically charged to the payment method on file
- You are responsible for keeping payment information current
4.3 Cancellation
- Cancel anytime via the Scout app or by contacting support
- Cancellation effective at end of current billing period
- No refunds for partial months
- Device continues to function for basic features; tracking requires active subscription
- You may cancel before the first 2 months free period ends and will not be charged
5. Use of Scout Services
5.1 Permitted Use
Scout is designed for:
- Tracking your own motorcycle for theft recovery
- Personal safety via crash detection
- Personal ride analytics
5.2 Prohibited Use
You may not use Scout to:
- Track vehicles you do not own without consent
- Stalk or harass individuals
- Violate any local, national, or international laws. In New Zealand, tracking individuals without consent may violate the Privacy Act 2020 and the Harassment Act 1997. You are solely responsible for ensuring lawful use
- Reverse engineer, modify, or tamper with the device or software
- Resell or redistribute Scout services without authorization
5.3 User Responsibility
- You are responsible for securing your Scout account credentials
- You are responsible for all activity under your account
- You must notify us immediately of any unauthorized access
6. Disclaimers & Limitations
6.1 Service Availability
Scout services depend on:
- Cellular network coverage (LTE-M availability)
- GPS satellite visibility
- Device battery charge or power connection
- Environmental factors (weather, obstructions, etc.)
We do not guarantee uninterrupted service or 100% uptime.
6.2 Theft Recovery
Scout is a theft deterrent and recovery aid, not a theft prevention guarantee. We cannot guarantee:
- Recovery of stolen vehicles
- Prevention of theft
- Police response or action
- Specific update rates or latency
6.3 Crash Detection
Crash detection is a best-effort system and should not replace:
- Proper safety equipment (helmets, protective gear)
- Emergency services (dial 111 in NZ, 000 in AU, or local emergency number)
- Medical alert devices for high-risk riders
False positives and false negatives may occur. Scout is not a medical device and is not certified for emergency response.
6.4 Ride Analytics
Ride data (speed, lean angle, etc.) is provided for informational purposes only. We do not guarantee accuracy and are not liable for decisions made based on this data.
7. Limitation of Liability
To the maximum extent permitted by law:
- Scout Moto is provided "AS IS" without warranties of any kind
- We are not liable for indirect, incidental, consequential, or punitive damages
- Our total liability is limited to the amount you paid for Scout products and services in the 12 months prior to the claim
- We are not liable for theft, injury, death, or property damage resulting from product use or failure
Some jurisdictions do not allow limitation of liability for personal injury or certain types of damages. If these laws apply to you, some limitations may not apply.
8. Warranty
Scout devices are covered by a 1-year limited hardware warranty from date of purchase (detailed terms provided with product).
Warranty covers:
- Manufacturing defects
- Component failures under normal use
Warranty does not cover:
- Physical damage from accidents, misuse, or improper installation
- Water damage (unless rated waterproof and properly sealed)
- Theft or loss of device
- Software issues resolvable via updates
- Normal wear and tear
9. Intellectual Property
All content, trademarks, logos, and intellectual property on the Scout Moto website and in Scout products are owned by Scout Moto or its licensors. You may not:
- Use our trademarks without written permission
- Copy, distribute, or modify our software or firmware
- Reverse engineer our products or services
10. Termination
We may terminate or suspend your access to Scout services if:
- You violate these Terms
- Your account is used for illegal activity
- Payment fails and you do not update payment information
- We discontinue the service (with reasonable notice)
Upon termination:
- Your access to Scout services will cease
- You may retrieve your data within 30 days
- No refunds for remaining subscription time (except as required by law)
11. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Significant changes will be notified via email to waitlist members and active customers.
Continued use of Scout after changes constitutes acceptance of the new Terms.
12. Governing Law & Disputes
12.1 Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
12.2 Dispute Resolution
For any disputes:

- We will attempt to resolve the issue informally within 30 days
- If unresolved, disputes may proceed to mediation or arbitration under New Zealand law
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
