⚠ Important Notice
Scout is designed as a theft deterrent and recovery aid, crash monitoring system, and ride analytics tool. It is not a guarantee of theft prevention, crash detection accuracy, or emergency response. Read this disclaimer carefully before using Scout.
1. General Product Limitations
1.1 Performance Dependencies
Scout's functionality depends on factors beyond our control:
- Cellular Network: Requires LTE-M coverage. Performance varies by carrier, location, and network congestion
- GPS Satellite Visibility: Accuracy affected by weather, terrain, buildings, tunnels, and atmospheric conditions
- Power Supply: Requires charged battery or 12V connection. Battery life varies with usage, temperature, and settings
- Environmental Factors: Extreme temperatures, moisture, vibration, and electromagnetic interference may affect performance
1.2 No Uptime Guarantee
We do not guarantee:
- 100% service availability or uptime
- Specific update rates or latency (e.g., "10-second updates" are typical but not guaranteed)
- Continuous GPS signal acquisition
- Real-time alerts without delay
2. Theft Tracking Limitations
2.1 Not a Theft Prevention System
Scout is a theft deterrent and recovery aid, not theft prevention. It does not:
- Prevent theft from occurring
- Guarantee vehicle recovery
- Replace physical security measures (locks, chains, alarms)
- Alert law enforcement automatically
2.2 Location Accuracy
- GPS accuracy typically 5-20 meters, but may be significantly degraded in poor conditions
- Location updates are frequent but not instantaneous
- Historical location data may be delayed or incomplete due to network conditions
- Scout may not function in areas without cellular coverage (remote areas, underground, etc.)
2.3 No Police Integration
Scout does not:
- Automatically notify law enforcement
- Guarantee police response or action
- Provide evidence admissible in court (consult legal counsel)
- Track vehicles across international borders (functionality limited to supported regions)
You must manually share location data with authorities. We do not coordinate with or report to law enforcement on your behalf.
2.4 Alarm System
The optional 95dB alarm:
- May not deter determined thieves
- Can be disabled if device power is cut
- Volume may be insufficient in noisy environments
- May cause noise complaints in residential areas (use responsibly)
3. Crash Detection Limitations
⚠ Critical Safety Notice
Crash detection is a best-effort system and is NOT a substitute for:
- Proper safety equipment (helmets, protective gear, riding courses)
- Emergency services (always dial 111 in NZ, 000 in AU, or your local emergency number)
- Medical alert devices for high-risk riders
Scout is not a medical device and is not certified for emergency response.
3.1 Detection Accuracy
Crash detection may experience:
- False Positives: Sudden braking, dropping the bike at low speed, hitting large potholes, or aggressive riding may trigger alerts
- False Negatives: Some crashes may not trigger detection (e.g., low-speed collisions, sliding without impact, prolonged deceleration)
- Delayed Alerts: Alerts depend on cellular connectivity and may be delayed or fail to send
3.2 User Responsibility
- You must dismiss false alerts within 60 seconds to prevent unnecessary emergency contact notifications
- You must keep emergency contact information current in the app
- You are responsible for informing emergency contacts about how Scout works
- If you are conscious and able after a crash, always call emergency services directly
3.3 No Liability for Missed Detection
We are not liable for:
- Failure to detect a crash
- Delayed or failed emergency notifications
- Injuries or death resulting from crash detection failure
- Actions taken (or not taken) by emergency contacts
4. Ride Analytics Limitations
4.1 Data Accuracy
- Speed, lean angle, distance, and route data are estimates for informational purposes only
- Sensor accuracy may degrade over time or with device wear
- GPS-based measurements are subject to signal quality and atmospheric conditions
- Data should not be used as evidence in legal or insurance matters without verification
4.2 Riding Score
- Riding scores are algorithmic assessments and do not constitute professional riding instruction
- A high riding score does not guarantee safety or skill
- Do not alter your riding behavior solely to achieve a higher score
5. Hardware & Installation
5.1 Installation
- Improper installation may damage your motorcycle or void its warranty
- Hardwiring to 12V electrical systems should be performed by qualified personnel
- Scout is not responsible for damage caused by improper installation
5.2 Water Resistance
- Water resistance ratings (if specified) apply only when device is properly sealed and undamaged
- Water damage is not covered under warranty if seals are compromised
5.3 Temperature Limits
- Operating temperature range: typically -10°C to 60°C (device-specific range provided in documentation)
- Performance may degrade or cease outside this range
- Do not expose device to direct exhaust heat or extreme cold for extended periods
6. Legal & Regulatory Compliance
6.1 User Responsibility
You are responsible for:
- Complying with all local, regional, and national laws regarding GPS tracking devices
- Obtaining consent where required (e.g., tracking vehicles owned by others, company vehicles)
- Ensuring alarm use complies with noise ordinances
- Not using Scout for unlawful surveillance or stalking
6.2 Privacy Laws
- Tracking individuals without consent may violate privacy laws
- Sharing location data with third parties is your responsibility
- Scout Moto is not liable for your misuse of tracking data
7. Changes & Updates
7.1 Product Specifications
Before shipping:
- Features, specifications, and pricing are subject to change
- Final specifications will be published before orders are fulfilled
- You may cancel your waitlist reservation at any time before payment
7.2 Firmware & Software Updates
- Scout functionality may change via over-the-air (OTA) updates
- Updates may add, modify, or remove features
- Some updates may be mandatory for security or network compliance
- We are not liable for compatibility issues with older firmware versions
8. Third-Party Services
- Scout relies on third-party cellular networks — we do not control network availability or performance
- GPS is operated by government entities (U.S. GPS, EU Galileo, etc.) — we do not control satellite availability
- Map data provided by third parties — accuracy not guaranteed
9. Limitation of Liability
To the maximum extent permitted by law:
- Scout Moto is provided "AS IS" without warranties, express or implied
- We are not liable for theft, loss, injury, death, or property damage resulting from Scout's use, failure, or malfunction
- We are not liable for indirect, incidental, consequential, or punitive damages
- Our total liability is limited to the amount you paid for Scout products and services
